What Are Developer Fees?
Developer fees, also known as school impact fees, are charges levied on new construction and development projects. These fees are required by state law under Government Code Section 65995 and are governed locally by the Campbell Union Elementary School District's Board Policy BP 7211. These funds are vital to offsetting the cost of increased enrollment resulting from new developments.
Education Code Section 17620 authorizes school districts to levy a fee, charge dedication, or other form of requirement against any development project for the construction or modernization of school facilities. These fees ensure our schools can accommodate the students generated by new residential and commercial development projects within the district boundaries.
What Are The Fee Rates?
The current developer fee rates for the district are as follows:

Note: Fees are subject to change based on annual adjustments and State Allocation Board updates.
Who Pays The Developer Fees?
Developer fees apply to:
- New residential construction, including single-family and multi-family developments.
- Additions to existing residential structures exceeding 500 square feet. For additions greater than 500 sq. ft., fees are calculated for the entire square footage of the addition.
- Accessory Dwelling Unit (ADU) exceeding 750 square feet. For additions greater than 750 sq. ft., fees are calculated for the entire square footage of the addition.
- Commercial and industrial developments within the district boundaries.
Is There A Board Policy Overview?
In accordance with Board Policy BP 7211, developer fees are assessed and collected to ensure the district has adequate resources to maintain and improve school facilities in response to growth. The policy outlines the district's authority to levy fees, the methodology for calculating them, and the proper use of collected funds.

What Is The Payment Process?
- Obtain Fee Certificate: Submit your developer fee impact fee referral form from the city to the Campbell Union School District Business Department. The department will calculate the applicable fees and issue a fee certificate.
- Pay Fees: Payments must be made in full before the building permit is issued. Payments can be made via cashier’s check, money order, or business checks. All checks must be made payable to Campbell Union Elementary School District. Note: NO cash, personal checks, credit cards, VENMO, ZELLE, or any other electronic payments are accepted.
- Collection of Fees: Service hours are Monday through Friday from 8:30 a.m. to 4:00 p.m., with a lunch break from 12:30 p.m. to 1:30 p.m. The District will also be closed in observance of major holidays, as well as during Winter Break in December and Spring Break in April.
- Submit Proof: Provide proof of payment to your local building department to complete your building permit process.
Are There Exemptions?
Certain developments may qualify for exemptions or reduced fees. These may include:
- Senior housing developments.
- Residential additions of 500 square feet or less.
- Reconstruction after a certain natural disaster.
- Facilities used exclusively for religious purposes.
- Facilities owned and occupied by any federal, state, or local government agency.
- Facilities used exclusively as private full-time day school (K-12)

Is There A Developer Fees Refund Policy?
Education Code section 17624 authorizes refunds; however, per Civil Code, section 338(a), the statute of limitations for a refund is three (3) years from when a refund becomes available. A refund becomes available once the building permit on which Developer Fees were paid expires.
